{"id":1269,"date":"2020-05-27T22:55:31","date_gmt":"2020-05-28T02:55:31","guid":{"rendered":"https:\/\/www.sesuperior.cl\/?p=1269"},"modified":"2020-05-27T22:55:31","modified_gmt":"2020-05-28T02:55:31","slug":"public-accountability-focus-on-quality","status":"publish","type":"post","link":"https:\/\/www.sesuperior.cl\/en\/sin-categoria\/cuenta-publica-foco-en-la-calidad\/","title":{"rendered":"Improve the quality of higher education institutions"},"content":{"rendered":"<p class=\"wp-block-paragraph\">As a supervisory body, we understand the need to promote conditions that allow for the normal and harmonious development of the system, alongside effective and proportional oversight, which must ensure that higher education institutions strictly comply with applicable regulations without inhibiting their activities.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">During this first year of operation, in the area of oversight, the main task we set for ourselves was to gather as much relevant information as possible from the system, in order to understand the true state of each of the institutions, primarily regarding the sustainability of the various educational projects. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Therefore, we request that the Ministry of Education provide all financial information from higher education institutions for recent years. Then, with that information, and aware of the complexities involved in overseeing a diverse and heterogeneous system, we began working on the development of a Risk-Based Supervision Model. The objective of this model is to focus the Superintendency's oversight actions and prevent scenarios that could affect the normal functioning of higher education institutions and potentially compromise their future viability. This tool, which to date has primarily considered financial elements, will integrate various factors that contribute to the proper development of an educational project.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Along these same lines, this Superintendency requested all educational institutions to provide the financial and contractual information required by law, which is of great relevance to the system. This includes audited financial statements; donations; acts, agreements, and transactions carried out with related parties; the partners, associates, and directors of the institutions; the participation of educational institutions in related entities; as well as various essential events reported by each of them. The analysis of this information has allowed us to gain a broad overview of the system's operations and, additionally, identify institutions that require our concentrated efforts.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In addition to this, the Superintendency has carried out various oversight actions in other matters, such as: non-compliance with obligations contained in educational service provision contracts; coexistence problems; non-compliance with the internal regulations of educational institutions; misleading advertising; withholding of documentation due to outstanding debts, among others. It should be noted that a large part of these actions arose from complaints and denunciations filed by the public, or were initiated by the Superintendency itself when conducting specific reviews of records submitted by the various educational institutions.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">To date, and during this first year of operation, the Superintendency has carried out a total of 1,053 inspection actions, covering a large part of the universe of institutions subject to our supervision.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Finally, we mention that this public account finds us in the full execution of the Special Fiscalization Plan for the measures adopted by institutions in the context of the health emergency caused by COVID-19, which constitutes our first contingency fiscalization plan, created to review the effective provision of educational services under conditions equivalent to those originally agreed upon.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">On the other hand, one of the powers granted to the Superintendency by law is to conduct administrative sanctioning processes and to apply sanctions if facts constituting violations of the law are verified. In this regard, during this first year of operation, 9 formal investigation processes and 9 administrative sanctioning processes were initiated, with sanctions being applied in the six cases that have already been closed. The main causes of these formal processes relate to the financial problems of the educational institutions or the failure to provide information to this Superintendency. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">On another note, one of the main concerns of higher education institutions, which we have gathered on various occasions when we have had the opportunity to hear their representatives, relates to the need to avoid duplication of requests by public bodies competent in higher education matters. This concern has been addressed from the outset by our Superintendency, which has sought to avoid unnecessary administrative overload and confusion in institutions through coordination with other public services and agencies.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">As a result of the above, highly relevant collaboration agreements were reached for our work.
